Our client, a full-service law firm, is seeking an Associate Attorney to support complex probate litigation and fiduciary matters in Boston, Massachusetts. The ideal candidate brings strong litigation judgment, clear communication skills, and the ability to manage matters from initial assessment through resolution.


Role: Probate Litigation Associate Attorney

Location: Boston, MA

Salary: $145,000 - $170,000 (depending on experience) + great benefits!

Schedule: Hybrid (3 days in, 2 days remote)


Responsibilities:

  • Manage probate and trust litigation matters from inception through resolution.
  • Draft pleadings, motions, memoranda, petitions, appellate briefs, and other legal documents.
  • Conduct legal research on the Massachusetts Uniform Probate Code, trust and estate law, fiduciary duties, guardianships, conservatorships, and related matters.
  • Handle all phases of discovery, including written discovery, document review and production, depositions, and discovery motions.
  • Prepare for and participate in evidentiary and motion hearings, status conferences, mediations, and trials.
  • Develop litigation strategy and case plans in collaboration with firm partners.
  • Advise fiduciaries on estate and trust administration issues arising in contested matters.
  • Review and analyze financial records, accountings, wills, trusts, and estate assets.
  • Coordinate with experts, including accountants, valuation professionals, physicians, and forensic specialists.
  • Negotiate settlements and participate in mediation and other alternative dispute resolution proceedings.
  • Maintain consistent communication with clients regarding case strategy, status, and developments.
  • Provide guidance and mentorship to junior associates and paralegals as needed.

Requirements:

  • J.D. from an accredited law school.
  • Admission to the Massachusetts Bar
  • 3–8 years of litigation experience in one of the following: Probate litigation, Trust litigation, Fiduciary litigation, Estate disputes, Will contests, Trust contests, Fiduciary removal actions, Guardianship litigation, Conservatorship litigation, Financial exploitation matters
  • Strong legal research and writing skills.
  • Excellent oral advocacy abilities.
  • Experience handling hearings and depositions.
  • Ability to independently manage a litigation caseload.
  • Exceptional analytical and organizational skills.
